Terms of Service

1. Scope

These terms apply to the use of the OceanPulse app ("App"), distributed for iOS via the Apple App Store. The app is operated by Ocean Pulse — Sebastian Theisen, Regerstrasse 98, 81541 Munich, Germany ("Provider"). By registering and using the app you accept these terms.

2. What the app does

  • Recording and managing dives, certificates and dream destinations
  • Statistics, badges and personal records
  • AI-assisted reading of logbook pages (requires separate consent)
  • Map view and dive site management
  • Storing a health certificate, insurance details and emergency contacts on your device

The app is not a medical device and gives no medical advice. The dive readiness check is a self-assessment aid. It replaces neither a dive medical examination nor the rules of your dive centre or the advice of a physician. If the app sends dives to Apple Health, the energy figure recorded there is an estimate from dive time and body weight, not a measurement — the app records no heart rate.

3. Free version and OceanPulse Premium

Free version

The free version includes the full range of functions with a cap on volume: up to 20 dives, 50 bucket-list entries and 1 certificate, plus 5 AI logbook scans per calendar month. If we change these limits, section 11 applies.

OceanPulse Premium

OceanPulse Premium is an auto-renewing subscription and comes in two terms: one month or one year. Both include exactly the same features — the term is the only difference. Both remove the volume caps and include 50 AI logbook scans per calendar month; with the annual term too, the allowance is monthly and not an annual pool. It resets at the start of each month and is not carried over. You choose the term before you confirm the purchase, and you can switch between them at any time through your Apple account.

The price applicable to you is always the one shown in the App Store and in the app before you confirm the purchase — it depends on your country, currency and applicable tax. We deliberately do not state a price here, so that no outdated figure can contradict the one you actually see.

4. Purchase, renewal and cancellation

For the iOS app, the subscription is purchased exclusively via Apple In-App Purchase. Payment is charged to your Apple Account. Apple acts as the registered seller and issues the invoice; the payment relationship is between you and Apple.

  • Automatic renewal: the subscription renews for a further term of the same length — one month or one year, whichever you chose — unless it is cancelled at least 24 hours before the end of the current period.
  • Charge: your Apple Account is charged within 24 hours before the start of the new period.
  • Cancellation: manage and cancel the subscription in the iOS Settings under your Apple Account > Subscriptions, or via the "Manage subscription" link in the app. Cancelling through us by email is not possible for App Store purchases.
  • Right of withdrawal and refunds: for purchases through the App Store, Apple provides the withdrawal information as the registered seller and handles the process. Apple grants the right to cancel an order within 14 days of receiving the invoice, without giving reasons; requests go to Apple at reportaproblem.apple.com. Note Apple's own restriction: a subscription can only be cancelled once it has first been taken out.

Why there is no separate withdrawal instruction from us here: for an App Store purchase it is not we who obtain your consent at the moment of buying, and it is not we who issue the invoice. Apple's Media Services Terms apply to that purchase. Apple describes its own role inconsistently there — as an intermediary that is not a party to the contract, and at the same time as the registered seller from whom you acquire the licence. We therefore do not assert here with whom the purchase contract is concluded. What is certain: the app and the service behind it are provided and licensed by us, your rights against us under these terms apply in full, and Apple grants and handles the 14-day cancellation right for the purchase.

5. What happens when Premium ends

Access remains until the end of the paid period. After that the account returns to the free version.

No data is deleted. Entries above the free limits remain stored and readable, and you can export them at any time. Only creating new entries is blocked until you are below the limit again or renew Premium.

6. Registration and account

  • A valid email address is required to use the app
  • You are responsible for keeping your password secure
  • You may not share your account with third parties
  • You can delete your account and all associated data yourself at any time, in the app under Profile > "Close account"
  • We may suspend accounts in the event of abuse

7. Your obligations

  • Do not upload unlawful, threatening or harassing content
  • Do not upload photos to which you do not hold the rights
  • Do not use the app for automated access (scraping, bots)
  • Do not circumvent security mechanisms or usage limits

8. Content and copyright

  • Your content: you retain all rights to the photos, texts and data you upload. You grant us a simple right of use to the extent necessary to operate the app.
  • Our content: design, code, icons, badges and texts of the app are protected by copyright and owned by the provider.
  • Anonymised data: we may use anonymised, non-personal data for community statistics (see privacy policy).

9. Availability and liability

  • We aim for high availability but do not guarantee 100% uptime
  • Maintenance may cause temporary restrictions
  • Keep your own backup of dives that matter to you. You can export your data at any time.
  • Liability: we are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee. In cases of slight negligence we are liable only for breach of an essential contractual obligation, and then limited to the damage foreseeable and typical for this kind of contract.

10. Donations / Ocean Fund

Where we state that a share of Premium revenue goes to ocean conservation, the current share and the recipients are named in the app. No individual donation receipts are issued. As long as no paid subscription is available, no such share exists.

11. Changes to these terms

We may amend these terms, for example when the law or the range of functions changes. We announce material changes in the app before they take effect. Your continued use alone is not treated as acceptance; if you do not agree, you can stop using the app and delete your account at any time.

Two limits on this, which apply regardless of any notice period: a change never reduces what an already paid subscription period includes — it takes effect for that account at the earliest with the next renewal. And a change to the subscription price is not made by us in the app: Apple notifies subscribers itself and, above certain thresholds, requires explicit agreement, without which the subscription simply does not renew.

12. Applicable law

German law applies. Mandatory consumer protection provisions of your country of residence remain unaffected. If any provision is invalid, the remaining provisions remain in force.
